Satur 2nd Feby 1825
Dear Sirs

Owing to my being home your
letter of the 29th only reached me today
I have since seen the Advocate &
the [Onesulent] & have written pretty fully to Mr
John Hope on the subject who I think will see
Mr. [Oul] & try to get to the bottom of this busineſs.
I called on Mr. Law but he had no
copy of the letter signed by him & Dr Abercromby, but
his recollection is that it stated pretty strongly the oppreſsion
& giddineſs I had in my head last Winter seſsion
in consequence of which they advised me to absent
myself from Court for a fortnight at one time after
having been absent before & I believe it will appear
that they say that I was not likely to get the better
of this if I continued to do the laborious duties of a Judge

If Dr Abercromby has not a copy I will write
you to get a copy & send it down
It may be as Mr [Oul] says that
it was not a certificate of Permanent informity in terms
of the act 48 93 for this was not held neceſsary the
Advocate [Onesulent] & also D Melville having held
Action from the words of the act that it was sufficient
that I had been 15 years in the County Seſsion
The [Onesulent] is quite clear that Mr
Hobhouse is sorry that this instruction is contrary
to the spirit of the Act. He says it was purposely so worded
to prevent a Judge from remaining in the Court of Seſsion
after he was not fit for the hearings waiting till he
had compleated 15 years service in the Justiciary, as it
often happens that many years intervene between the
two appointments.
If you hear any thing further I shall
inſist to hear. I am at a loſs to know who has [shared] in
this busineſs but probaby Mr Hope my [¿] this
