It is Contracted agreed and matrimonially [¿]
between Archibald Campbell writter to the signett second lawfull son
of William Campbell of Succoth with the speciall advice and Consent of his
said father and the said William Campbell for himself and for his son
right and Interest in manner after mentioned Off the one part and
Mrs Helen Wallace only lawfull Child and heir of the now Deceased
John Wallace of Elderslie with the speciall advice and Consents
of Mrs Jean Kennedie Relict of the said John Wallace her mother
now spouse of Mr Lawrance Drummond merchant in Glasgow and
the said Mr Lawrance Drummond ald also of Sir Hugh Montgomrie
of Skermarlie Barronett Colin Campbell of Bytheswood James
Douglaſs of Mains Mr Arthur [¿] merchant in Glasgow Mr Wiliam
Wood Chamberlain to the marqs of Clydesdale and Mr Dvid
Turner Minister of the Gospell att Greenock The whole accepting
Curators [¿] and appointed by her Conform to the act of [¿]
extracted thereupon dated the day of
Registrate in the Commiſsarie Court Collis of
Glasgow the day of
of the other part as Follows. That is to say whereas the saids
Archibald Campbell and Mrs Helen Wallace have solemnized and
Consummat the bond of marrige with Each other And that tho
there was no Contract Extended between them before the solemnization
of the said marriage yett the settlement and Terms after written were
Communed and agreed upon by both parties and were Judged rationall
and Equall and are now Condescended too and agreed upon by them
and therefore and in Consideratioun of the said Marriage the
said William Campbell hereby Binds and oblidges himself his heirs
Exers and Succeſsors whatsomever. To pay to the sid Archibald
Campbell his heir Exer or aſsigneys The sum of four Thousand merks
Scots monie of Principall In name of portion with his said son and that
att the first [¿] of Whitesunday [¿] Martinmaſs or Christmaſs
next after his Decease with Eight Hundred merks Monie forsaid of
Liquidate penaltie in Case of failzie and the lawfull Interest of the
said Principall Sum from and after the saids [¿] Terms of payment
[¿] and untill payment of the same And which sum the said Archibald

Campbell hereby accepts in full satisfaction to him of all Legittim portion
naturall share of moveable or others whatsever That he Can ask or
Claim by and through his said fathers Decease Excepting his
oun Good will [¿] or that he might succeed as [¿] att law
to him In Case off the Decease of his Elder brother as also
the said Archibald Campbell In Consideration of the said Marrige
and of the lands and sums after mentioned Contracted to him by the said
Mrs Helen Wallace in name of [¿] in manner after secifyed hereby
Binds and oblidges him his heirs Exers and Succeſsors Whatsoever that
whatever lands Heretages Both sums of monie or other Heretable or moveable
Goods and Gear Whatever he shall [¿] acquire or Succeed to during
the standing of the present marriage That he shall lay out and
Employ on land or other sufficient securitie and Take the rights and
securities of the said Conquest In favours of himself and the said Helen
Wallance In Conjuct [¿] and liferent and to the heirs and Bairns to be
procreat between them [¿]. But for the said Helen Wallace her
Further securities only of the Respective liferent provisions after specifyed
provided to her In the Events after mentioned Viz In case the said
Helen Wallace happen to survive the said Archibald Campbell and
that there be no Children att all procreat of the said Marriage & Existing
att the Diſsolution of the same the forsaid Conquest so to be [¿] out and
secured shall be her securitie to the said Helen Wallace of the
liferent of one Thousand pound scots yearly from and after her said
Husbands decease being the Interest Corresponding by Law for the
time to the principall sum of Thirty Thousand merks or for securitie
to her of such another Interest or annuitie as shall Correspond by
Law for the time to the said principall sum of Thirty Thousand Merks
To be Restricted always the said liferent provision in Case
of one or Two Doughter and no heirs male Existing att the Diſsolution
of the said Marriage to the sum of Twelve Hundred merks money forsaid yrly
being the Interest Corresponding by Law for the time to the said prinll sum and
In case Eitehr of heirs male or three or more Doughters
Existing at the Diſsolution of the said marriage then the said liferent
provision shall be further Restricted to the sum of one Thousand merks
monie forsaid yearly being the Interest Corresponding by law for the

time to the sum of Twenty Thousand merks monie forsaid of Principall
or such annother Interest as shall Correspond by law for the time
to the said Principall sum with this provision nevertheleſs that altho
Children shall Exist all the Diſsolution of the said Marriage
Yett if they shall all faill Except one or Two Doughters or if
they shall whollie faill before majority or marriage Then the
said liferent provision shall Immediatly be augmented to the said ſum of
Twelve Hundred merks or one thousandpounds scots In manner as is Provided
in the [¿] Events before mentioned in Case Eitehr of no Children Existing
att all or only one Two Doughters. That is to say If no Children
Exist att the Diſsolution of the marriage the said one Thousand pound
Scots is to Take place and be payable att the first Term after the said
Archibalds Campbells Decease or tho they Do Exist and thereafter all faill
Except one or Two Doughters or if they whollie faill before Majority
or marriage then the said liferent provision is Immediatly upon [¿]
so failling to be augmented to the saids [¿] sums of Twelve Hundred
merks or one Thousand pound Scots according as the saids events shall
happen In manner forsaid and which Conquest the Said Archibald
Campbell not only oblidges himself to secure In favours of Himself
and the said Mrs Helen Wallace In Conjunct Fee and liferent and the heirs
before specifyed in Fee for her futher securitie onlie of her saids [¿]
liferent provisions In manner before Mentioned But also to pay
the saids Respective liferent provisions in the Severall Events before [¿]
to the said Mrs Helen Wallace her heirs or aſsigneys During all
the Days of her lifetime in Case she survive him the said Archibald
Campbell and that att Two Terms in the year Whitesunday and Martts
by Equall portions with one Hundred and fifty merks monie forsaid
of penaltie for Each Terms failure in Case thereof and that [¿]
all reall legall or publick burdens whatever as also and in Case
the said Mrs Helen Wallace Survive her said Husband and tht there
shall be Children of the said marriage Existing att the Diſsolution
thereof the said Archibald Campbell hereby aſsigns Disones
and makes over to her the one Just and Equall half and if no Children
Existing att the Diſsolution of the said marriage the whole household
furniture [¿] Domicill ſilver plate without Deduction
of [¿] moveables and Generally all other furniture whatever which
shall happen to pertain to the said Archibald Campbell att the Time of
his Decease and that Free of all debts burdens or Impedements what¬
ever whereof his other heirs are hereby bound to Relieve her With
